Effective Date: October 7, 2026 Last Updated: October 7, 2026
Giften, LLC, doing business as Giften Market 7483 Cahill Road, Edina, MN 55439 · 952-260-7499
1. Overview and Acceptance
These Terms of Service govern your use of giftenmarket.com and any related services, including our online store, ordering tools, gift delivery services, Gift of Choice services, e-gift services, and customer support services, collectively referred to as the "Services."
The Services are operated by Giften, LLC, doing business as Giften Market, a Minnesota limited liability company. In these Terms, "Giften," "we," "us," and "our" refer to Giften, LLC and Giften Market.
The Services are hosted on Shopify Inc. By visiting our site, placing an order, creating an account, or using the Services, you agree to these Terms and to the policies they reference, including our Privacy Policy, our Refund Policy, and our Shipping Policy.
If you do not agree to these Terms, do not use the Services or place an order.
If you use the Services for a company, employer, organization, or other business, you confirm that you have authority to bind that entity to these Terms. In that case, "you" includes both you and the entity you represent.
2. Who May Use the Services
You must be at least 18 years old, or the age of majority in your state of residence, to place an order through the Services.
We ship only within the United States, and every order must be delivered to a U.S. address.
You may not use the Services:
- For any unlawful purpose;
- In violation of any applicable federal, state, or local law;
- To infringe or violate another person's rights;
- To transmit a virus, worm, Trojan horse, spyware, ransomware, or other harmful code; or
- In a way that could damage, disable, overburden, or impair the Services.
3. Your Account
You may be required to create an account to use certain features of the Services. You are responsible for keeping your account credentials confidential and for all activity under your account.
You agree to provide current, complete, and accurate purchase, account, payment, and delivery information, including your name, email address, billing information, payment details, and shipping address. You agree to update this information promptly if it changes.
You may not use another person's account without permission. You must notify us promptly if you believe your account or account credentials have been accessed or used without authorization.
We may suspend or close an account as described in Section 20.
4. Orders, Prices, and Payment
All prices are in United States dollars unless we state otherwise.
The price shown at checkout is the price that applies to the order, except in the case of a clear pricing or description error. We may change prices, product descriptions, promotions, and availability at any time before an order is accepted.
We may accept or decline any order. We may also limit quantities per person, per household, per order, or per recipient address.
If an order is affected by a clear pricing, product, inventory, or description error, we may cancel the order and refund the amount paid for that order. If we cancel an order after payment has been processed, we will refund the payment to the original payment method unless applicable law requires another method.
Where an order is quoted or invoiced, payment is due on the terms stated in the quote or invoice. A quote is valid for 14 days unless it states a different expiration date. A quote is not an acceptance of an order and does not reserve inventory unless we expressly state otherwise.
You confirm that you are authorized to use the payment method you provide. You authorize us and our payment processors to charge the payment method for the order total, including applicable products, shipping charges, taxes, and other amounts disclosed at checkout or in the applicable quote or invoice.
Sales tax is calculated at checkout or on the applicable invoice based on the shipping address and other information available to us. If you claim a tax exemption for a business or corporate order, you must provide a valid exemption certificate before we are required to apply the exemption.
5. Products, Substitutions, and Availability
Product availability can change. Products may be removed from the Services at any time.
Product images are illustrative. Colors, materials, packaging, labels, and other details may vary slightly. Monitor settings and other device settings can affect how colors appear.
Where an item in a gift box is unavailable, we may substitute an item of equal or greater value of a similar kind. We will not knowingly substitute an item that conflicts with the stated intent of the gift box. For example, we will not knowingly substitute a food item into a sympathy gift where the stated gift design does not call for food.
Substitutions may be necessary because of inventory, supplier, shipping, seasonal, regulatory, or other operational conditions.
Custom and build-your-own orders are produced to your specifications. Once production or personalization has begun, custom and build-your-own orders generally cannot be cancelled or returned except as required by law or where the product is damaged, defective, or incorrect.
6. Shipping and Delivery
We ship within the United States only, to street addresses and to P.O., F.P.O., and A.P.O. boxes in all 50 states. We do not ship internationally, and we do not deliver to hospitals.
Individual in-stock orders ship within one business day. Orders placed by 1:30 p.m. Central Time, Monday through Friday, ship the same day. Orders placed after 1:30 p.m. Central Time, or on a weekend or holiday, ship the next business day.
Every order ships from our studio in Edina, Minnesota.
Estimated delivery times after shipping are:
- Standard shipping: 1 to 5 business days
- Express shipping: 1 to 3 business days
- Overnight shipping: 1 business day
Carriers generally deliver Monday through Friday. Delivery windows are estimates provided by the carrier and are not guarantees. Actual delivery times may vary based on the carrier, destination, weather, holidays, package volume, address issues, and other circumstances.
You are responsible for providing a correct and complete delivery address. If an order cannot be delivered because the address is incorrect or incomplete, you may be responsible for additional shipping charges, return charges, or other reasonable costs.
Title to goods passes to you when we hand the shipment to the carrier. For consumer orders, risk of loss passes when the shipment is delivered to the address you provided or when the carrier records delivery.
If we cannot ship an order within the time stated at checkout, in the applicable quote, or in these Terms, we will notify you of the delay and provide any cancellation, consent, or refund option required by applicable law.
If a shipment is damaged or lost, tell us within 7 days of the expected or recorded delivery date. Please include photographs of the damage and the packaging when available. We will review the issue and, where appropriate, replace the affected item, issue a refund, or provide another reasonable resolution.
We are not responsible for delays caused by weather, carrier disruption, incorrect or incomplete address information, recipient unavailability, acts of government, labor disputes, natural disasters, or other events outside our reasonable control.
7. Refunds and Returns
This Section is a summary. The full policy is our Refund Policy. If there is a conflict between this summary and the current Refund Policy, the current Refund Policy controls unless applicable law requires otherwise.
You may request a return within 30 days of delivery. Items must be unused, in the condition you received them, and in the original packaging. You will need proof of purchase.
The following items are not returnable or refundable:
- Food and perishable items;
- Gift cards and e-gift cards;
- Personalized, custom, and build-your-own items;
- Final sale merchandise; and
- Any item identified as non-returnable in its product description.
Damage, defects, or an incorrect item must be reported within 7 days of delivery, with photographs when available. For an approved damage, defect, or fulfillment-error return, we will provide a prepaid return label or another appropriate return method.
For a change-of-mind return, return shipping is your responsibility unless the Refund Policy states otherwise.
Refunds are issued to the original payment method after we receive and inspect the returned item, within a reasonable period. The timing of the refund may also depend on the payment provider or financial institution.
We may grant a partial refund where an item is not in its original condition or is missing parts for reasons that are not our fault.
Please do not send a return to the manufacturer. Contact us at for return instructions before sending a return.
Nothing in this Section limits any rights or remedies that cannot be waived under applicable law, including rights relating to defective or unsafe products.
8. Gift Cards, E-Gift Cards, and Gift of Choice
Gift cards and e-gift cards sold by Giften do not expire. We do not charge dormancy, service, or inactivity fees.
Gift cards and e-gift cards are not refundable or exchangeable for cash except where applicable law requires it.
Treat a gift card, e-gift card, and redemption code like cash. We are not responsible for a lost, stolen, copied, intercepted, or misused card or code, except to the extent required by law or caused by our own error or failure to use reasonable security measures.
Gift of Choice links allow a recipient to select a gift from the available options. A Gift of Choice link is generally valid for a single redemption. Any redemption window, expiration date, product limitation, geographic restriction, or other condition shown at the time of purchase or in the Gift of Choice communication applies to that link.
A Gift of Choice recipient may be required to provide a delivery address and other information needed to fulfill the selected gift.
Available products, gift tiers, and redemption options may vary. If a selected product is unavailable, we may offer a reasonably comparable substitute or another option.
Where a gift card or Gift of Choice balance is used toward an order and that order is refunded, the balance may be restored to the original gift card or code rather than refunded as cash.
9. Gifts Sent to Someone Else, Including Recipients
When you buy a gift for someone else, you are our customer. The recipient is a beneficiary of your order but is not a party to these Terms solely because they receive a gift.
You confirm that you have the right to give us the recipient's name, delivery address, email address, phone number, and any message, photograph, logo, or other content you ask us to include. You also confirm that providing this information and content does not breach any law or any right of the recipient or another person.
We use recipient details to produce, personalize, and deliver the order, confirm delivery, handle delivery problems and returns, provide customer service, and perform other purposes described in our Privacy Policy.
We may contact a recipient about delivery, order-related issues, or, where the gift is a Gift of Choice, the process for redeeming the gift.
We will not add a recipient to our marketing lists without the recipient's own consent. A recipient may opt out of any marketing message at any time.
If you are the recipient of a gift and would like us to delete your details, contact . We will process the request subject to our Privacy Policy and records we must keep by law.
10. Corporate, Wholesale, and Multi-Recipient Orders
Corporate and business-to-business orders may be quoted, invoiced, or placed through the Services.
A quote is valid for 14 days unless it states otherwise. A quote does not reserve inventory or guarantee availability unless we expressly state that it does.
Once production, personalization, packing, or other fulfillment work for a custom order has begun, the order cannot be cancelled except as agreed in writing or as required by law.
For orders shipped to multiple recipients, you are responsible for the accuracy and completeness of the recipient list you provide, including recipient names, addresses, phone numbers, email addresses, delivery instructions, and gift messages.
You confirm that:
- You have the right to use every logo, image, trademark, name, message, and other content you supply;
- You have collected and shared recipient information with us lawfully;
- You have provided any notices and obtained any consents required by law;
- The recipient information is accurate and sufficient for delivery; and
- Your instructions do not require us to violate any law or another person's rights.
You grant us a limited, non-exclusive, royalty-free license to reproduce, modify as reasonably necessary for production, and use the logos, images, messages, names, and other content you supply solely to produce, personalize, package, and deliver your order and to maintain records of the order.
You are responsible for any sales, use, or similar tax that applies to your order. You must provide a valid exemption certificate where you claim exemption.
If you buy through a marketplace or wholesale platform such as Faire, that platform's own terms, policies, payment procedures, shipping procedures, return procedures, and dispute procedures also apply. Where those terms conflict with these Terms on the marketplace transaction, the platform's terms control for that transaction.
Unless a written agreement states otherwise, these Terms apply to the Giften Services used for corporate and business orders.
11. Content You Send Us
You keep ownership of the messages, photographs, images, logos, trademarks, and other content you send us, subject to the rights of any third parties.
You grant us a non-exclusive, royalty-free license to use that content only to produce, personalize, package, and deliver your order and to maintain records of the order.
You confirm that you have all rights needed to send us the content and for us to use it as described in these Terms.
We may refuse or remove content that is unlawful, infringing, hateful, threatening, abusive, defamatory, discriminatory, misleading, or otherwise objectionable.
We are not obliged to keep your content confidential, and we do not pay for it, except that personal information is handled as described in our Privacy Policy.
Reviews, comments, photographs, and other public submissions may be used by us as described in our Privacy Policy. We may edit public submissions for length, formatting, spelling, or clarity, without changing their material meaning.
You should not send us confidential information through a public review, comment, or other publicly accessible feature.
12. Third-Party Services and Links
Some features of the Services rely on third-party services, including multi-recipient sending tools, payment processors, email and SMS delivery services, review tools, analytics services, fraud-prevention tools, and other technology providers.
Third-party services have their own terms and privacy policies. We are not responsible for the acts, omissions, content, policies, security, availability, or performance of third-party services.
When you use a third-party service through our site, we may share the information needed for that service to work. Our Privacy Policy describes how we work with service providers.
Third-party links on our site are provided for convenience. A link does not mean that we endorse, sponsor, or approve the linked site, service, product, or organization.

The Services, our site content, text, photographs, product designs, and branding are owned by Giften, LLC or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or use them commercially without our written permission, other than as needed to use the Services normally. - Your physical or electronic signature.
We will remove or disable access to the material as appropriate and may notify the person who posted it.
15. Accuracy of Information on the Site
We work to keep the information on our site accurate and current, but mistakes happen. Information about products, pricing, promotions, shipping, and availability may contain errors. We may correct those errors, update information, or cancel an affected order at any time before or after you place it.
Nothing on our site, including our blog posts, gift guides, and pages aimed at business buyers, is legal, tax, regulatory, or compliance advice, and you should not rely on it as such. Confirm any regulatory or compliance question with your own advisers.
16. Disclaimers
The Services and products are provided on an "as is" and "as available" basis. We do not promise that the Services will be uninterrupted, secure, or error free, or that they will meet your expectations.
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including your rights under Minnesota consumer law and, where applicable, the Magnuson-Moss Warranty Act.
17. Limitation of Liability
To the fullest extent permitted by law, Giften, LLC, including our officers, employees, agents, and service providers, will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or replacement costs, arising out of or relating to your use of the Services, even if we were told those damages were possible.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services, or to a product or order, will not exceed the amount you paid us for the product or order giving rise to the claim.
Nothing in this section limits liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited or excluded.
18. Indemnification
You agree to indemnify us against third-party claims and reasonable costs, including attorneys' fees, that arise from your breach of these Terms; content you supplied that you did not have the right to use; personal information about a recipient or another person that you supplied without the rights, notices, or consents the law requires; or your unlawful use of the Services. This does not apply to the extent a claim results from our own negligence or our breach of these Terms. We will tell you about a covered claim, and we may take over its defense.
19. Electronic Communications and Notices
You agree to receive notices, disclosures, and other communications from us electronically, including at the email address on your order or account. Keep that email address current, because a notice sent to the most recent email address you gave us is effective. You accept these Terms electronically.
Legal notices to us must be sent to Giften, LLC, 7483 Cahill Road, Edina, MN 55439, Attention: Legal, with a copy emailed to . Questions and notices about an order can be sent to .
20. Suspension and Termination
These Terms apply while you use the Services. You may stop using the Services at any time, but that does not cancel an order you have placed or an amount you owe. We may suspend or cancel your access, or decline or cancel an order, if you breach these Terms, if we reasonably suspect fraud or unlawful activity, if we cannot verify information you provided, or if we are required to do so by law. Sections 14, 15, 16, 17, 18, 19, 22, and 24 survive termination.
21. Changes to These Terms
We may update these Terms. The current version is always on this page, with the Effective Date and Last Updated date shown at the top. For material changes, we will take reasonable steps to bring them to your attention, such as posting a notice on the site. Changes apply to orders placed after the change takes effect. If you do not agree to a change, stop using the Services.
22. Governing Law and Venue
These Terms and any dispute arising out of or relating to them, the Services, or any product are governed by the laws of the State of Minnesota and applicable United States federal law, without regard to conflict of laws rules. Subject to Section 23, the state and federal courts located in Hennepin County, Minnesota have exclusive jurisdiction, and you and we consent to venue there. Nothing in this section takes away any right you may have to bring a claim in your local courts where the law gives you that right.
23. Resolving a Dispute
If you have a problem with an order or with the Services, please contact us first at so we can try to resolve it. Most issues can be fixed quickly. If we cannot resolve it informally, either of us may bring a claim in the courts identified in Section 22, subject to any right you have to bring a claim in your local courts.
24. Other Terms
If any part of these Terms is found unenforceable, that part will be limited or removed to the smallest extent necessary and the rest of these Terms stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and us about the Services and replace any earlier agreement on the same subject. You may not transfer your rights under these Terms without our written consent. We may transfer our rights, including in connection with a merger, acquisition, or sale of assets. Headings are for convenience only and do not affect meaning.
