1. Introduction
Giften, LLC ("Giften," "we," "us," or "our") operates giftenmarket.com and related services (the "Services"). This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our website, place an order, contact us, sign up for our communications, or otherwise interact with us across our consumer, business, wholesale, and corporate gifting channels.
This Policy applies to information about U.S. residents and, where indicated, residents of other jurisdictions. By using our Services, you acknowledge the practices described in this Policy.

2. Information We Collect
2.1 Information You Provide
We collect information you provide when you:
- Place an order or attempt to place an order (name, billing and shipping addresses, payment information, email, phone number)
- Create a customer account
- Subscribe to our email or SMS communications
- Submit a B2B, wholesale, or corporate gifting inquiry (company name, role, contact information, gifting needs)
- Submit a product review
- Contact customer support, including via chat, email, AI assistant, or phone
- Personalize a greeting card or gift message
- Participate in surveys, promotions, contests, or referral programs
2.2 Information Collected Automatically
When you interact with our Services, we automatically collect:
- Device and browser information (IP address, browser type, operating system, device identifiers, screen resolution)
- Usage data (pages and products viewed, time on site, referring and exit URLs, search terms, clicks)
- Approximate location derived from IP address (we do not collect precise GPS location)
- Information collected through cookies, pixels, and similar technologies (see Section 6)
2.3 Information from Third Parties
We may receive information about you from:
- Advertising, analytics, and attribution partners (audience data, conversion and attribution data, ad performance)
- Marketplaces and sales channels (such as Amazon and Faire) when you purchase from us through those platforms
- Social media platforms when you interact with our content or accounts
- Service providers that help us verify, enrich, or secure customer data
3. How We Use Your Information
We use personal information to:
- Process and fulfill orders, including warehouse picking, shipping, returns, and exchanges
- Operate, maintain, and improve our Services and the customer experience
- Communicate with you about orders, account activity, customer service, and policy updates
- Send marketing communications, including email and SMS, when you have consented or where otherwise permitted by law
- Personalize your experience, including product recommendations and AI-assisted shopping and support
- Measure, attribute, and optimize the performance of our marketing across channels

- Comply with legal, regulatory, tax, and accounting obligations
- Establish, exercise, or defend legal claims
4. How We Share Your Information
4.1 Service Providers and Sub-Processors
We share information with third-party service providers, vendors, and sub-processors (collectively, "Service Providers") that help us operate, secure, support, and improve our Services. These include providers of:
- E-commerce platform, cloud hosting, and infrastructure
- Payment processing
- Warehouse management, order fulfillment, and shipping carriers
- Email and SMS marketing, delivery, and customer messaging
- Advertising, attribution, and analytics, including session-replay and behavioral analytics
- Customer product reviews
- AI-assisted shopping and customer support
- Customer relationship management (CRM), lead capture, and marketing automation for our business, wholesale, and corporate gifting channels
- Greeting card personalization and on-demand printing
- Workflow automation between our systems
- Security, identity verification, and fraud prevention
- Sales channels and marketplaces
We require Service Providers, by written agreement, to:
- use information only as necessary to provide services to us or as required by law;
- maintain appropriate administrative, technical, and organizational safeguards to protect the information;
- refrain from selling the information or using it for their own independent purposes; and
- handle information in a manner consistent with this Policy and applicable data protection laws.
We also require Service Providers to notify us without undue delay of any security incident affecting personal information processed on our behalf.

Where Service Providers process personal information outside your country of residence, we rely on appropriate cross-border transfer mechanisms, such as Standard Contractual Clauses or other lawful safeguards.
4.2 Advertising Partners
We share certain information with advertising partners, including Google and Meta, to deliver, measure, and improve advertising. This may include hashed identifiers (such as hashed email addresses) for audience matching, and online activity data collected through pixels and tags. You may opt out of personalized advertising as described in Section 7.
4.3 Marketplaces and Sales Channels
When you purchase through a marketplace such as Amazon, or a wholesale platform such as Faire, your information is also processed by that platform under its own privacy policy in addition to ours.
4.4 Legal and Protective Disclosures
We may disclose information when we believe in good faith that disclosure is necessary to:
- Comply with applicable laws, regulations, subpoenas, court orders, or other legal process
- Cooperate with law enforcement or regulatory authorities
- Protect the rights, property, safety, or security of Giften, our customers, or others
- Investigate or prevent fraud, security incidents, or violations of our terms
4.5 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, personal information may be transferred as part of that transaction. We will provide notice where required by applicable law.
4.6 With Your Consent
We may share information with other parties when you direct us to do so or otherwise consent.
5. Categories, Sources, and Purposes (CCPA/CPRA Disclosures)
For California residents and to support disclosures required under other state privacy laws, the following summarizes the categories of personal information we have collected, used, disclosed, or shared in the preceding twelve (12) months.
Categories of personal information collected:
- Identifiers: name, email address, postal address, phone number, account ID, IP address, device identifiers
- Customer records: billing and shipping addresses, payment information (processed by our payment processor; we do not store full card numbers)
- Commercial information: purchase and return history, products viewed, cart contents, reviews and ratings, gifting preferences
- Internet or network activity: browsing and search history on our Services, clicks, referrer information, device and browser data
- Geolocation: approximate location derived from IP address (not precise GPS)
- Professional or employment information: for business, wholesale, and corporate gifting customers (company name, job title)
- Inferences: preferences, predicted interests, marketing audience segments
Sensitive personal information: We do not knowingly collect government identification numbers, precise geolocation, racial or ethnic origin, religious beliefs, biometric data for identification, health information, genetic data, or the contents of mail, email, or text messages other than communications directly with us.
Sources of personal information: directly from you; automatically through your use of our Services; from advertising, analytics, and attribution partners; from marketplaces and sales channels; and from Service Providers acting on our behalf.
Categories of recipients: Service Providers and sub-processors as described in Section 4.1; advertising partners as described in Section 4.2; marketplaces and sales channels as described in Section 4.3; and recipients of legal or protective disclosures as described in Section 4.4.
Business and commercial purposes for collection, use, and disclosure: as described in Section 3.
"Sale" and "sharing": We do not sell personal information for monetary consideration. We share certain identifiers and online activity with advertising partners (such as Google and Meta) for cross-context behavioral advertising, which may be considered a "sale" or "sharing" under California law and similar laws of other states. You may opt out as described in Section 7.

6. Cookies and Tracking Technologies
We use cookies, pixels, web beacons, tags, and similar technologies to operate the Services, analyze usage, personalize your experience, and deliver and measure advertising.
Categories of cookies and similar technologies:
- Strictly necessary: required for the Services to function, including cart, checkout, and security
- Functional: preferences, language, recently viewed products
- Analytics: measure how visitors use our Services (for example, Google Analytics, attribution providers, and behavioral analytics tools)
- Advertising: support advertising and measurement (for example, Google Ads and Meta pixels), including attribution and conversion-measurement tools that may share data with advertising platforms (for example, Google Ads, Meta pixels, and marketing attribution providers such as Triple Whale)
Session-replay and behavioral analytics. Some of our analytics tools (for example, Microsoft Clarity) capture anonymized records of how visitors interact with our Services, including mouse movements, clicks, scrolling, and rage-click signals. These tools help us identify usability issues and improve the customer experience. We configure these tools to automatically mask sensitive form fields (such as payment information) and we do not use them to identify individual users. Where required by law, we will obtain your consent before activating these tools.
You can manage cookies through our cookie banner and through your browser settings. Disabling certain cookies may affect functionality.
We do not currently respond to "Do Not Track" browser signals. However, we honor recognized opt-out preference signals (such as Global Privacy Control) where required by law.
7. Your Privacy Rights
7.1 General Rights (All Customers)
You can at any time:
- Opt out of marketing emails by clicking "unsubscribe" in any marketing email
- Opt out of SMS messages by replying STOP to any marketing text from us
- Request access, correction, or deletion of your personal information by contacting hello@giftenmarket.com
7.2 California Residents (CCPA/CPRA)
California residents have the right to:
- Know what personal information we collect, use, disclose, sell, or share
- Request access to and a copy of personal information we hold about you
- Request correction of inaccurate personal information
- Request deletion of personal information
- Opt out of the sale or sharing of personal information
- Limit the use and disclosure of sensitive personal information (we do not use sensitive personal information for purposes that require this right to be offered)
- Not receive discriminatory treatment for exercising your rights

To exercise other rights, contact hello@giftenmarket.com. We will verify your identity before responding. You may designate an authorized agent to act on your behalf with proof of authorization.
We will respond within the timeframes required by law (generally 45 days, extendable by an additional 45 days where permitted).
7.3 Other U.S. State Residents
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, New Jersey, Delaware, and other states with comprehensive privacy laws have rights to:
- Access their personal information
- Correct inaccurate personal information
- Delete personal information
- Obtain a portable copy of their personal information
- Opt out of targeted advertising, the sale of personal information, and certain profiling

7.4 Visitors from the European Economic Area, United Kingdom, and Switzerland
Giften sells and ships only within the United States, and we do not actively offer goods or services to residents of the EEA, UK, or Switzerland. However, if you visit our Services from these regions, certain analytics, advertising, and behavioral measurement technologies may process limited information about your visit.
If you are a resident of the EEA, UK, or Switzerland, you may have the right to access, rectify, erase, restrict, or port personal information we hold about you; to object to processing; to withdraw consent at any time (without affecting prior processing); and to lodge a complaint with your local supervisory authority.
Where we process personal information about you, the legal bases include (i) your consent (for marketing communications and non-essential cookies), (ii) our legitimate interests in operating, securing, and improving our Services, and (iii) compliance with legal obligations.

8. SMS and Text Message Terms
By providing your phone number and opting in, you consent to receive recurring marketing and transactional text messages from Giften, including cart reminders, order updates, shipping notifications, and promotional offers.

9. Children's Privacy
Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 (or under 16 in the EEA and UK). If you believe a child has provided us personal information, contact hello@giftenmarket.com and we will take steps to delete it.
10. International Data Transfers
Giften is based in the United States and sells only to U.S. customers. If you visit our Services from outside the U.S., any information we collect (such as cookie, analytics, and behavioral data) is processed in the United States and other countries where our Service Providers operate. Where required by law, we rely on Standard Contractual Clauses or other lawful transfer mechanisms.
11. Data Retention
We retain personal information for as long as needed for the purposes described in this Policy, subject to the following general guidelines:
- Order and transaction records: as long as needed to fulfill the order and as required by tax, accounting, and consumer protection law (typically up to 7 years)
- Customer accounts: as long as your account is active, plus a reasonable period after closure
- Marketing data (email and SMS): until you opt out or after a period of inactivity (typically 24–36 months)
- Customer support and AI assistant records: typically up to 3 years after the last interaction
- Web analytics: as configured with each analytics provider, typically 14–26 months
- Advertising audiences and attribution data: as configured with each provider, typically up to 13 months
- Security and access logs: typically up to 12 months, unless retained longer for security or legal purposes
Where required by law, we may retain information longer to comply with legal obligations, resolve disputes, or enforce our agreements.
12. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information. These include:
- Encryption of data in transit (TLS)
- PCI-DSS compliance for payment processing through our payment processor
- Access controls and role-based permissions
- Vendor due diligence and written data protection agreements with Service Providers
- Ongoing security monitoring and incident response
No method of transmission or storage is 100% secure. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.
13. Third-Party Links and Services
Our Services may contain links to third-party websites, social media platforms, or services that we do not operate. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before sharing personal information.
14. Changes to this Policy
We may update this Policy from time to time. We will post the updated version and revise the "Last Updated" date at the top. For material changes, we will provide additional notice (such as by email to account holders or a notice on our website) before the changes take effect, where required by law.
